Ordinance may be cited as the Securities (Insider Dealing)
Ordinance.
nterpretation
In this Ordinance, unless the context otherwise requires--

A person is connected with a corporation for the purposes of
section 9

各市州、县(市、区)国土资源局:
《湖南省土地开发整理项目管理办法》已经2007年9月29日厅务会议审议通过,现予印发,请遵照执行。执行中的问题,请及时告省厅。

湖南省土地开发整理项目管理办法
第一章 总 则
第一条 为规范土地开发整理项目管理,保障土地开发整理项目质量,发挥土地开发整理资金效益,根据《中华人民共和国土地管理法》、《湖南省土地开发整理条例》等相关法律法规和政策的规定,结合本省实际,制定本办法。
第二条 本办法所称土地开发整理项目(以下简称项目),是指省以上财政投资、省土地开发整理机构作为业主承担的土地开发整理项目。
第三条 省国土资源厅负责项目的计划、立项、设计审批、预算审查、实施监督检查以及验收等行政管理工作。
省土地开发整理机构负责项目的前期工作、组织实施、工程验收等项目管理中的技术性、事务性工作。
市州国土资源局负责本行政区域项目的选址踏勘、组织申报、实施管理等相关工作。
县(市、区)国土资源局负责项目申报和实施的相关工作。
第二章 项目申报立项
第四条 省国土资源厅根据土地开发整理规划、土地利用年度计划和土地开发整理专项资金收入预算,制定并下达项目申报年度计划。
第五条 项目申报程序:
(一)市州国土资源局根据土地开发整理规划,按有关规定组织项目选址踏勘,拟定申报项目。
(二)项目拟定后,市州土地开发整理机构组织县(市、区)土地开发整理机构委托具有相应资质的单位按照有关技术规程编制项目可行性研究报告。
(三)项目可行性研究报告编制完成后,县(市、区)国土资源局应当报请县(市、区)人民政府组织农业、林业、水利、环境保护等部门和项目所在地乡镇人民政府以及有关方面的专业技术人员进行论证。通过论证的项目,经市州国土资源局审查后纳入项目库。
(四)市州国土资源局根据省国土资源厅下达的项目申报年度计划申报立项。
第六条 项目申报材料:
(一)市州、县(市、区)国土资源局项目申报文件;
(二)项目可行性研究报告;
(三)县(市、区)人民政府组织项目可行性论证的文件,县(市、区)有关部门的审查意见,征求村组、群众意见的情况说明,项目选址踏勘报告;
(四)其他有关资料。
第七条 项目申报条件:
(一)符合土地利用总体规划、土地开发整理规划、当地农业发展和农村建设规划;
(二)土地相对集中连片,建设规模一般为300—1000公顷,片块一般不超过3片,具备基本的农业生产条件;
(三)土地开发项目的新增耕地率一般应当达到百分之六十,土地整理项目的新增耕地率一般应当达到百分之三;
(四)项目区无土地权属纠纷,经项目涉及地村民会议三分之二以上成员或者三分之二以上村民代表同意。
第八条 省国土资源厅受理项目申报材料后,由省土地开发整理机构从土地开发整理专家库中按相关规定抽取专家,依据有关技术规范和要求进行项目立项的技术性审查,并将审查意见报省国土资源厅。
省国土资源厅组织项目立项会审,通过会审的项目,批准立项。
第九条 项目应当优先在基本农田保护区、粮食主产区安排。
严格控制土地开发。禁止在法律法规规定和土地开发整理规划划定的禁止开垦区域内开垦耕地。
第三章 项目设计和预算编制及审查
第十条 项目立项后,由市州土地开发整理机构组织具有丙级以上测绘资质的测绘单位按照有关技术规范对项目区现状进行测绘。测绘比例尺一般不小于1∶2000。
第十一条 项目区测绘工作完成后,由市州土地开发整理机构委托具有相应资质的单位,依据项目立项批复和有关技术规范编制项目设计和预算。
设计方案形成后,县(市、区)土地开发整理机构应在项目区进行公告,征求项目所在地乡镇人民政府、村民委员会、村民小组和村民的意见。
设计方案确定后,设计单位应当依据项目设计,按照预算定额标准和有关规定编制项目预算。
第十二条 项目设计和预算应满足编制施工招投标文件、设备材料采购制作和指导施工的需要。
具有较强专业特点的桥梁、渡槽、塘坝等单体工程,应由具有专业资质的设计单位进行设计。
第十三条 市州国土资源局应当会同相关部门、组织专业技术人员按照有关规范对项目设计和预算进行审查。审查通过后,报省土地开发整理机构。申报的材料包括:
(一)项目设计和预算文本、图册;
(二)征求乡镇人民政府和村组、群众意见的情况说明;
(三)市州国土资源局组织的审查意见;
(四)其他有关资料。
第十四条 省土地开发整理机构应当从土地开发整理专家库中按相关规定抽取专家,依据有关技术规范和要求,对项目设计和预算进行技术性审查。
第十五条 省国土资源厅根据项目设计和预算技术性审查意见,审定项目建设任务,审批项目设计,审核项目预算,确定年度项目计划,并将项目预算报省财政厅审批。
第十六条 省财政厅下达项目预算后,省国土资源厅向省土地开发整理机构下达项目建设任务和预算。
第四章 项目实施准备
第十七条 省土地开发整理机构根据下达的项目建设任务和预算,制定项目实施计划,分配项目建设任务和预算,组织有关单位做好项目实施前的准备工作。
第十八条 市州土地开发整理机构组织县(市、区)土地开发整理机构编制项目实施方案,并对项目实施方案进行审查。
项目实施方案的主要内容包括:项目建设目标和主要技术指标,组织实施机构,工程监理和招投标组织形式,工程进度和资金使用计划,财务、权属、档案等管理制度。
第十九条 市州土地开发整理机构按有关规定选定监理单位。监理单位应根据有关规定,制订工程监理方案,并报市州土地开发整理机构审定。
第二十条 市州国土资源局按照有关规定确定工程招投标组织形式,参与招投标方案的审查和招投标的监督工作,并根据项目特点,建立施工单位的行业管理制度。工程招投标鼓励推行“合理定价评审抽取法”。
第二十一条 县(市、区)国土资源局应报请县(市、区)人民政府成立项目实施领导小组,协调解决项目实施中的有关问题。
第二十二条 县(市、区)土地开发整理机构按照有关规定公告项目实施方案的主要内容,做好项目实施的宣传发动和设计交底,组织施工单位完成设备、材料的准备和项目开工前的清场工作。
第五章 项目实施
第二十三条 省、市州、县(市、区)国土资源部门应当按照各自职责,加强实施管理,全面、及时掌握项目实施情况,协调解决项目实施的问题。
项目建设各单位应当按照有关法律法规的规定和合同的约定,各司其职,各负其责,做好项目实施的各项工作。
第二十四条 项目施工单位应当按照项目设计和有关技术标准进行施工,建立质量责任制,确定工程及工段的项目经理、技术负责人和施工管理负责人。对出现质量问题或验收不合格的工程,负责返工或返修。对因违反项目设计、施工合同延误农时或造成其他损失的,依法负责赔偿。
第二十五条 工程监理单位应当依照项目设计、有关技术标准和相关合同进行工程监理,对工程投资、质量和进度进行控制,承担监理责任。
第二十六条 项目设计单位应当参与设计交底,负责项目实施中有关设计的咨询、指导等技术性服务工作。项目设计确需变更的,负责按有关规定进行修改。
第二十七条 县(市、区)土地开发整理机构负责项目施工现场管理,对施工单位、监理单位和设计单位进行管理,控制工程投资、质量和进度;组织分部、分项工程验收;协调处理项目实施中出现的矛盾和问题,维护农民工合法权益,做好工程设施移交工作;即时收集整理项目档案资料。
第二十八条 市州土地开发整理机构负责项目实施管理工作,督促监理单位、设计单位按照有关规定和合同约定,实施工程监理,提供技术服务;督促县(市、区)土地开发整理机构和有关方面按照项目实施方案实施及施工;建立项目实施巡查制度,检查项目实施进度、工程质量、投资等情况。
第二十九条 省土地开发整理机构负责项目组织实施工作,按规定及时请拨付项目资金;定期开展项目实施的稽查;按规定及时办理项目设计变更,对发生的不可预见情况进行现场核实;调度和检查项目实施进度、质量、资金使用等情况,研究解决项目实施中的重要问题。
第六章 项目土地权属管理
第三十条 开发整理的土地,其土地所有权性质不变。
项目土地权属管理应当遵循依法、公开、公平的原则,确保土地权利人的合法权益不受侵害,维护社会稳定,促进经济发展。
第三十一条 县(市、区)国土资源局应当在县级人民政府的统一领导下,会同相关部门、乡镇人民政府加强项目区土地权属管理工作。
第三十二条 项目立项和设计阶段,应明确土地权属和土地利用现状,有权属争议且一时无法调处的土地不能纳入项目范围。县(市、区)国土资源局应当会同相关部门、乡镇人民政府,按照有利生产、方便生活的原则,编制土地权属调整方案。
土地权属调整方案应充分征求有关村民委员会、村民小组和村民意见,报县级人民政府批准。
土地权属调整方案批准后,应按规定在项目所在地进行公告。
第三十三条 项目批准立项后,应冻结土地权利变更,一般不作权属调整和土地利用现状变更。
因项目设计变更造成土地权属调整方案变更的,应编制土地权属调整补充方案,并按规定进行公告、报批。
第三十四条 因项目实施确需调整土地所有权界线的,由双方土地所有权人签订土地调整协议,并由县(市、区)国土资源局报县级以上人民政府批准。
因项目实施确需调整土地使用权的,由县(市、区)国土资源局批准。
因项目实施致使农民集体土地承包经营权发生变化的,应经村民会议三分之二以上成员或三分之二以上村民代表的同意,并报乡镇人民政府和县级人民政府农业主管部门批准。
第三十五条 土地权属调整涉及他项权利的应通知他项权利人参加。
第三十六条 土地权属调整争议由县级国土资源部门会同有关部门、乡镇人民政府,按照有关规定进行调处。
第三十七条 工程施工结束后,县(市、区)土地开发整理机构应当按照土地权属,及时移交土地和有关设施,明确管护责任,落实耕种。
第三十八条 项目竣工后,应按经批准的土地权属调整方案及时进行土地权属调整、变更调查和登记发证工作。
第七章 项目资金管理
第三十九条 项目资金实行专款专用、专账核算。各级国土资源部门和土地开发整理机构应当建立完善的资金管理制度。
第四十条 项目资金实行预算管理。资金拨付和使用必须控制在项目预算范围内,不得办理超范围、超预算和虚列的支出。
第四十一条 项目建设任务和预算下达后,根据国库集中支付的有关规定,按照项目实施进度,分期将项目资金分别拨付到省、市州、县(市、区)土地开发整理机构。
第四十二条 项目资金请拨付工作应遵循严格管理、实事求是、追踪问效的原则。
项目工程款的拨付,由县(市、区)土地开发整理机构提出申请,工程监理出具工程进度和质量意见,市州土地开发整理机构实地核实,市州国土资源局签署意见,省土地开发整理机构按有关规定拨付工程款。
第四十三条 各级土地开发整理机构应当按照事业单位会计制度和有关规定,建立项目财务管理制度,按项目建立专账,准确反映项目资金使用和会计核算情况。
第八章 项目验收
第四十四条 项目工程施工结束后,市州或县(市、区)土地开发整理机构应委托具有相应资质的中介机构进行工程结算审计。
第四十五条 县(市、区)土地开发整理机构应当及时办理工程结算,编制竣工财务决算报告,收集整理有关资料后,向市州土地开发整理机构申请工程初验,县(市、区)国土资源局向市州国土资源局申请项目初验。
申请工程初验和项目初验应当提交申请报告,并附具项目竣工报告、工程监理报告、工程结算审计报告、竣工财务决算报告、土地权属报告以及项目竣工图等资料。
第四十六条 市州国土资源局及其土地开发整理机构应当按照有关规定,及时组织项目所在地乡镇人民政府以及农业、水利等方面的专业技术人员与村民代表进行工程初验和项目初验。
初验合格的,市州土地开发整理机构出具工程初验报告,市州国土资源局出具项目初验意见。
第四十七条 通过初验的,省土地开发整理机构应当按照有关规定,及时进行工程验收,并评价项目完成情况和综合效益,出具工程验收报告。
省国土资源厅委托具有相应资质的中介机构,进行项目资金使用情况审计。
第四十八条 通过工程验收的,由省土地开发整理机构向省国土资源厅申请项目验收。申请项目验收应当提交申请报告,并附具工程验收报告、土地权属报告、工程监理报告、项目财务决算报告与项目资金使用审计报告等资料。
第四十九条 省国土资源厅按有关规定组织项目验收。
项目验收合格的,由省国土资源厅向省土地开发整理机构下达项目验收意见。验收不合格的,由省国土资源厅责令省土地开发整理机构限期组织整改,直至验收合格。
第九章 监督检查
第五十条 各级国土资源部门应当建立监督检查制度,对项目实施进度、工程质量、资金使用、廉政建设等情况进行监督检查。
第五十一条 各级国土资源部门应建立项目管理责任制,明确项目实施和管理的责任目标,并对责任目标执行情况进行考核、奖惩。
第五十二条 省国土资源厅负责对项目预算执行情况、资金使用与管理情况进行监督检查。各级土地开发整理机构应当主动接受监督检查,如实反映情况,提供所需资料。
第五十三条 省、市州土地开发整理机构应建立健全项目实施巡查稽查、责任制等管理制度,对项目实施进度、工程质量、资金使用等情况进行日常监督检查。
第五十四条 各级国土资源部门及其土地开发整理机构应建立对项目测绘、设计、监理、施工、审计等专业机构的业绩考核、诚信考评等制度,切实加强行业管理和监督检查。
第十章 附 则
第五十五条 各市州、县(市、区)国土资源局应结合本地实际,参照本办法制定本级投资的项目管理办法。
第五十六条 本办法由省国土资源厅负责解释。
第五十七条 本办法自发布之日起施行。原《湖南省土地开发整理项目管理暂行办法》同时废止。
